Data Processing Agreement

This Data Processing Agreement ("DPA") forms part of the Terms of Service and Privacy Policy between G N CO SOLUTION (Pty) Ltd ("Monitor STS") and users of its Services (the "Customer").

1. Definitions

"Data Protection Law" means the Protection of Personal Information Act, 2013 ("POPIA") and any applicable privacy legislation in South Africa.
"Personal Data" means any information relating to an identified or identifiable natural person processed by Monitor STS on behalf of the Customer.
"Processing", "Processor", and "Controller" have the meanings set out in POPIA.

2. Subject Matter and Duration

Monitor STS shall process Personal Data on behalf of the Customer as necessary to provide GPS tracking and vehicle monitoring services. The DPA shall remain in effect for the duration of the Customer's use of the Services.

3. Nature and Purpose of Processing

Monitor STS processes Personal Data to:

Enable vehicle tracking via GPS devices
Manage user accounts
Process payments via Yoco
Provide support and communication

4. Obligations of Monitor STS

Monitor STS shall:

Process Personal Data only on documented instructions from the Customer
Ensure confidentiality of personnel authorized to process data
Implement appropriate technical and organizational measures to ensure data security
Assist the Customer with data subject requests and incident response
Delete or return all Personal Data upon termination of the service unless retention is required by law

5. Sub-processors

Monitor STS uses third-party service providers, including:

Yoco (Payment processing)
Hosting providers
Email communication platforms

Monitor STS ensures sub-processors are bound by data protection obligations compatible with this DPA.
